3.1 Account Creation

To use certain features of our services, you may need to create an account. You can register using:

• Email and password authentication
• Google Sign-In (OAuth)

You agree to provide accurate, current, and complete information during registration and to update your information as necessary.

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activities.

4.1 Valid Prescriptions Required

All prescription medications and compounded formulations require a valid prescription from a qualified and registered healthcare practitioner. We comply with all applicable Australian pharmacy laws and regulations.

4.2 Prescription Verification

We reserve the right to verify prescriptions with the prescribing practitioner and may refuse to dispense if we have concerns about safety, legality, or appropriateness.

4.3 Medical Advice Disclaimer

Information provided on our website is for educational purposes only and does not constitute medical advice. Always consult with qualified healthcare professionals for medical guidance and treatment decisions.

5.1 Order Process

When you place an order through our website or services, you are making an offer to purchase products. We reserve the right to accept or reject any order at our discretion.

6.2 Collection

Products may be collected from our pharmacy during business hours. Valid identification may be required for prescription medications.

7.1 Prescription Medications

Due to regulatory requirements and safety concerns, prescription medications generally cannot be returned once dispensed. Exceptions may be made for:

• Dispensing errors made by our pharmacy
• Damaged or defective products
• Products not meeting Australian therapeutic standards

7.2 Over-the-Counter Products

Non-prescription products may be returned within 30 days of purchase if unopened and in original packaging, with proof of purchase.

7.3 Compounded Medications

Compounded medications are custom-made to order and generally cannot be returned. We will remake preparations at no charge if there are quality issues or dispensing errors.

You agree to indemnify and hold harmless Gardens Pharmacy, The Mortar & Pestle, and our directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your violation of these Terms
• Your misuse of our services
• Your violation of any laws or third-party rights
• Fraudulent or illegal activities

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of New South Wales.
